Terms and Conditions
1. Introduction
These Terms and Conditions govern the purchase and use of Porsche Approved Extended Warranty (Warranty) policies
sold online in New Zealand by European Motor Limited (Porsche NZ).
By purchasing a policy, you agree to these Terms and Conditions and the conditions set out in the Porsche Approved Warranty Certificate (Warranty Certificate) which will be issued to you once your offer to purchase the Warranty has been confirmed. Your Warranty coverage will relate to the Porsche vehicle stated in the Warranty Certificate (Your Vehicle).
If there is any inconsistency between these terms and your Warranty Certificate, the wording in the Warranty Certificate will prevail to the extent of that inconsistency.
2. Your Rights Under the Consumer Guarantees Act (CGA)
The Consumer Guarantees Act 1993 provides minimum guarantees for goods and services purchased for personal use. These guarantees include:
- Products must be of acceptable quality, meaning they:
- Are fit for their intended purpose.
- Are durable for a reasonable period.
- Are free from faults.
- Perform as described.
If you have a serious problem with a product, you may choose a refund, replacement, repair, or compensation.
If the problem is minor, the seller may choose to repair, replace, or refund.
These rights apply regardless of this Warranty and cannot be excluded. For more information, visit http://www.comcom.govt.nz.
3. Cooling-Off Period
You have the right to cancel your Warranty within 14 days of your Warranty Certificate being issued. To cancel:
- Notify us by phone, email, post, or in person.
- If cancelled within 14 days, you will receive a full refund of the amount paid for the Warranty
4. Warranty Coverage and Exclusions Overview
What your Warranty covers, and what is excluded from coverage is set out in your Warranty Certificate.
Coverage Overview
You are entitled to have defective Porsche components (those which are covered under the Warranty) repaired or replaced free of charge in Your Vehicle during the Warranty coverage period set out in your Warranty Certificate in respect of the following components of Your Vehicle:
- Engine
- Fuel and cooling system
- Drive and transmission
- Suspension and steering
- Brake system
- Heating and air conditioning
- Electrical system
- Body.
This policy provides benefits beyond your CGA rights as it includes:
- Access to Porsche Roadside Assistance (24/7) during your Warranty coverage period for breakdowns of Your Vehicle.
- Accommodation or transport allowances if breakdown of Your Vehicle occur more than 100km from home and repair takes over 24 hours up to a maximum value of $250 per day.
- Worldwide coverage with no mileage limit during the Warranty coverage period.
- Warranty exclusions are set out in your Warranty Certificate. At a high level, the Warranty does not cover:
- Visual and acoustic defects that do not impair functionality.
- Indirect or consequential damages, including towing costs, overnight accommodation, vehicle hire, and loss of use (especially if spare parts are delayed) except as stated elsewhere in these terms.
- Costs for testing, measuring, adjustment, maintenance, inspection, care, cleaning, procurement, disposal, freight, and dispatch not directly connected to a covered defect.
- Damage caused by ageing and natural wear and tear, including but not limited to:
- Wiper blades
- Tyres
- Brake pads and discs
- Shock absorbers
- Clutch plate and pressure plate
- Drive belt including deflection and tensioning rollers
- Spark plugs
- Batteries (including high-voltage batteries)
- PDCC expansion tank
- Refrigerant
- All lights (excluding Xenon & LED lights)
- All filters, fluids, oils and greases
- Damage caused by misuse, accidents, theft, natural phenomena, or unauthorised modifications of Your Vehicle.
- Damage resulting from participation in driving events or associated practice drives of Your Vehicle.
- Damage caused from Your Vehicle not being properly repaired, maintained or serviced by a non-authorised e service centre.
- Damage caused by unapproved parts being installed in Your Vehicle.
- Damage caused by unapproved parts affecting parts covered by the Warranty.
- Any deliberate or grossly negligent conduct or fraudulent misrepresentation by you.
- Maintenance work associated with a warranty repair is expressly excluded.
5. Eligibility
Only eligible Porsche vehicles receive the benefit of the Warranty. Eligibility criteria includes:
- Available for qualifying Porsche vehicles up to 15 years of age.
- Your Vehicle must be maintained as per the requirements in the Vehicle’s Guarantee & Maintenance booklet prior to the purchase of the Warranty and at all times during the Warranty coverage period.
- Your Vehicle must not have been modified from standard production condition.
- Any other criteria set by Porsche NZ from time to time. You can contact an Official Porsche Service Centre to check whether - your vehicle meets all the current eligibility criteria.
- Motor vehicle dealers purchasing a Porsche vehicle for resale are not eligible to purchase a new warranty or be transferred the benefit of an existing warranty.
- All amounts owing to Porsche NZ to purchase the Warranty must have been paid in full at the time the claim
arises.
6. Claims Process
- Claims under the Warranty must be made at an Official Porsche Service Centre. You will need to present your Warranty Certificate at the time you make the claim.
- Parts that are replaced become Porsche NZ’s property.
- You should make a claim as soon as you are aware of a defect arising.
- You have cover for defects which arise during the Warranty coverage period set out in your Warranty Certificate.
However, you must make claims within 12 months after the defect first occurs and no later than 12 months after the date your Warranty coverage period expires
7. Transferability
Your Warranty is transferable for its remaining coverage period when Your Vehicle is sold, or traded, to an Official Porsche Service Centre, or sold to a private purchaser.
Your Warranty will be deemed to end, and be no longer valid if your Porsche vehicle is sold or traded via any other motor
vehicle dealers.
8. Limitation of Liability
Claims for defects are limited to the market value of Your Vehicle at the time the defect arises.
